BACKGROUND:
This agreement applies as between you, the user of this website and Squirrel Medical Ltd the owner of this website. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the website. If you do not agree to be bound by these terms and conditions, you should stop using the website immediately.

Squirrel Medical Ltd makes no warranty or representation that the website will meet your requirements, that it will be of satisfactory quality, that it will be fit for a purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from the use of our Service.
5.2. No part of this Website is intended to constitute advice and the Content of this website should not be relied upon when making any decisions or taking any action of any kind. This applies especially to the links to research journals concerning endothelial function and other health outcomes. The reason for making research journals available is to help persons interested subjects such as Endothelial Function, find journals of interest easier.

To the maximum extent permitted by law, Squirrel Medical Ltd accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Website or any information contained therein. 7.2. Nothing in these terms and conditions excludes or restricts Squirrel Medical Ltd’s liability for death or personal injury resulting from any negligence or fraud on the part of Squirrel Medical Ltd.
7.3. Every effort has been made to ensure that these terms and conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977. However, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This term shall apply only within jurisdictions where a term is illegal.
8. No Waiver
In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.
9. Previous Terms and Conditions
In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.
10. Goods, Pricing and Availability
10.1. Whilst every effort has been made to ensure that all graphical representations and descriptions of Goods available from Squirrel Medical Ltd correspond to the actual Goods, Squirrel Medical Ltd is not responsible for any variations from these descriptions.
10.2. Where appropriate, you may be required to select the required size, model, colour, number and features of the Goods that you are purchasing.
10.3. Squirrel Medical Ltd does not represent or warrant that such Goods will be available. Stock indications are not provided on the website
10.4. All pricing information on the website is correct at the time of going online. Squirrel Medical Ltd reserves the right to change prices and alter or remove any special offers from time to time and as necessary.
10.5. In the event that prices are changed during the period between an order being placed for Goods and Squirrel Medical Ltd processing that order and taking payment, you will be contacted prior to your order being processed with details of the new price and the option to proceed with or to cancel your order.
11. Value Added Tax (VAT)
11.1. VAT will be charged at the standard rate on all applicable products. Our website prices are often shown as both excluding VAT (where applicable) and including VAT.
11.2. Members of the public with chronic illness or disability may be subject to VAT exemption. Please e mail us for details at baker.gary001@gmail.comWe regret that VAT cannot be credited at a later date if the required VAT exemption declaration is not received at time of ordering.
12. Third Party Rights
Nothing in these Terms and Conditions shall confer any rights upon any third party. The agreement created by these Terms and Conditions is between you and Squirrel Medical Ltd
13. Communications
13.1. All notices / communications shall be sent to us either by post to our Premises (see address above) or by email to baker.gary001@gmail.com. Such notice will be deemed received 3 days after posting if sent by first class post, the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday.
13.2. Squirrel Medical Ltd may from time to time send you information about our products and/or services. If you do not wish to receive such information, please click on the unsubscribe link of any e mail that you may receive from us.
14. Orders Placed Via Website
When you place an order to purchase a product from Squirrel Medical.com, we will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product which is accepted by us when we send e-mail confirmation to you that we’ve dispatched that product to you (the “Dispatch Confirmation E-mail”).
We aim to deliver all orders placed via the website within 12 weeks. As we process your order, we will inform you by e-mail if any products you order turn out to be unavailable.
Due to the extraordinary demand placed on Squirrel Medical Ltd for its products, the company is offerng customers the chance to pre order Squirrel Medical products. This requires the customer to place a nominal deposit of £100. This places the customer in a que. As product becomes available, the customer will be contacted and the balance of the transaction must be paid in full prior to dispatch.
15. Delivery
Squirrel Medical Ltd will try to deliver the goods as arranged with you. The delivery dates are given as accurately as possible, but cannot be guaranteed. We aim to deliver all orders placed via the website within 12 weeks. Squirrel Medical Ltd cannot accept responsibility for being unable to deliver or for late, mistimed deliveries or for any costs incurred. You are not entitled to claim damages or cancel the order if we are unable to deliver on the pre-arranged dates. If we deliver to a business or home address at your request, you are agreeing that anyone situated at such address has your written authority to accept goods on your behalf and where needed, assist unloading of goods. We will accept no responsibility for goods once they have been delivered to and signed for at the requested address.
16. Your Right To Cancel
If you have ordered from our website and you are unhappy with your purchase for any reason, or change your mind, and notify us within 10 weeks of delivery, we will offer you a refund of the goods. You will need to cover the costs of returning the goods including insurance and shipping and ensure that the goods are returned to Squirrel Medical Ltd in exactly the same condition as you received them. The reason for the 10 weeks money back guarantee, is that it will allow you to assess your own health outcomes, before and afterb 8 weeks Squirrel Medical use.
17. Who Owns The Goods
Title of goods remain the property of Squirrel Medical Ltd until the payment has been received in full. Until that time, we may recover the goods at any time.
18. Warranty
Squirrel Medical Ltd warrants to the purchaser that all parts are free of defects on materials and workmanship for a period of one year from the date of purchase, which covers the cost of parts and labour for faulty manufacture. We may replace or repair the faulty goods at our discretion. Squirrel Medical Ltd will not be liable for any defect in the Goods arising from fair wear and tear, wilful damage, accident, negligence or use other than that intended.
19. Faulty Or Missing Goods
It is your responsibility to check your consignment, and if any incorrect or damaged goods are supplied or items are missing, you must notify us within 24 hours of delivery and furthermore give notice in writing to the company within 7 working days after the date of delivery/collection. The goods may be returned for either refund in full, or replacement. Failure to do so will mean that the Goods shall be deemed to have been delivered/collected undamaged and in accordance with the delivery documents. After this period, a charge for replacements may be made if required. Faulty goods must be returned and inspected before replacements are dispatched.
20. Complaints Policy
We will treat your complaint confidentially, seriously and quickly. It is really important to let our staff know that you are unhappy and to give them the chance to put things right. Otherwise, please request our complaint form to initiate a formal complaints process.
21. Law and Jurisdiction
These terms and conditions and the relationship between you and Squirrel Medical Ltd shall be governed by and construed in accordance with the Law of England and Wales and Squirrel Medical Ltd and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
